WHEREAS, the Philippine Constitution provides for the protection and advancing the right
of the people to a balanced and healthful ecology in accord with the rhythm and harmony of
nature (Section 16, Article 2).
WHEREAS,the Local Government Units shall share with the national government
responsibility in the management and maintenance of ecological balance within their
territorial jurisdiction (Section 3 (i) of R.A. 7160);
WHEREAS,to address the throw-away attitude among its users and recover as much plastic
bags from waste stream, it is deemed necessary to implement an effective system of
plastic bag recovery;
WHEREAS, it will also prevent improper disposal of food service containers and to prevent
litter in all tourism sites, parks and beaches within the jurisdiction of the Province of Ilocos
Sur;
WHEREAS, Single-Used Plastics (SUPs) would cause to the environment because plastics
are non-biodegradable, staying in the environment for thousands of years, and would produce
toxic chemicals that are harmful to human health when incinerated, causing cardiovascular
disease to cancer and autoimmune conditions;
WHEREAS, plastic cellophane and sando bags and expandable polystyrene (EPS) Foams
being non-biodegradable materials clog our canals, creeks, rivers and other water ways
causing floods during rainy season and causing harm to these waterways and the surrounding
communities;
WHEREAS, plastic cellophane and sando bags and expandable polystyrene (EPS) Foams are
widely used for packaging of foods and beverages, however, the use of plastics and
polystyrene in food storage can carry health risks, especially when hormone disrupting
chemicals from some of these packaging materials leach into food and beverages;
WHEREAS, plastic cellophane, sando bags and polystyrene are rampantly used as
packaging material in the Province of Ilocos Sur and elsewhere;
WHEREAS, despite serious efforts of the Province to segregate biodegradable, recyclable
and reusable waste materials, plastics, polystyrene and other similar materials remain in the
Control No.:

SECTION 1. TITLE- This Ordinance shall be known and referred to as the “ORDINANCE
BANNING ALL SINGLE-USE-FOOD SERVICE CONTAINER AND SINGLE-USE-
PLASTIC (SUPs) BAG IN ALL TOURISM SITES, PARKS AND BEACHES WITHIN
THE PROVINCE OF ILOCOS SUR’’
SECTION 5. PROHIBITED ACTS – It is hereby prohibited for any person, whether natural
or juridical, to:
a. Bring and Use Single-Use-Food Service Container and Single-Use-Plastic (Sups) Bag
in All Tourism Sites, Parks and Beaches within the Province of Ilocos Sur;
c. Stores and other retail establishments in all tourism sites, parks and beaches are
mandated to use any alternative legally compliant packaging material for customers,
such as but not limited to the materials mentioned in Section 3 hereof, in lieu of
single-use plastic cellophanes and sando bags.
SECTION 13. REPEALING CLAUSE- All laws, orders, regulations, or parts thereof,
inconsistent with the provisions of this Ordinance, are hereby repealed or modified
accordingly.
SECTION 14. SEPARABILITY CLAUSE-In event or for any reason/s, any part/s, sections/s
or provision/s of this Ordinance shall be held or declared be unconstitutional or invalid, the
remaining part/s thereof which are not affected thereby, shall continue to be effective and in
full force.
SECTION 15. EFFECTIVITY- This ordinance shall take effect 15 days upon approval,
posting and publication pursuant to the provisions of the Local Government Code of 1991.
