AN ORDINANCE BANNING SINGLE-USE POLYSTYRENE FOODCONTAINERS


AND SINGLE-USE-PLASTIC BAG IN ALL TOURISM SITES, PARKS AND
BEACHES WITHIN THE PROVINCE OF ILOCOS SUR

WHEREAS, the Philippine Constitution provides for the protection and advancing the right
of the people to a balanced and healthful ecology in accord with the rhythm and harmony of
nature (Section 16, Article 2).
WHEREAS,the Local Government Units shall share with the national government
responsibility in the management and maintenance of ecological balance within their
territorial jurisdiction (Section 3 (i) of R.A. 7160);
WHEREAS,to address the throw-away attitude among its users and recover as much plastic
bags from waste stream, it is deemed necessary to implement an effective system of
plastic bag recovery;

WHEREAS, it will also prevent improper disposal of food service containers and to prevent
litter in all tourism sites, parks and beaches within the jurisdiction of the Province of Ilocos
Sur;

WHEREAS, Single-Used Plastics (SUPs) would cause to the environment because plastics
are non-biodegradable, staying in the environment for thousands of years, and would produce
toxic chemicals that are harmful to human health when incinerated, causing cardiovascular
disease to cancer and autoimmune conditions;

WHEREAS, plastic cellophane and sando bags and expandable polystyrene (EPS) Foams
being non-biodegradable materials clog our canals, creeks, rivers and other water ways
causing floods during rainy season and causing harm to these waterways and the surrounding
communities;
WHEREAS, plastic cellophane and sando bags and expandable polystyrene (EPS) Foams are
widely used for packaging of foods and beverages, however, the use of plastics and
polystyrene in food storage can carry health risks, especially when hormone disrupting
chemicals from some of these packaging materials leach into food and beverages;
WHEREAS, plastic cellophane, sando bags and polystyrene are rampantly used as
packaging material in the Province of Ilocos Sur and elsewhere;
WHEREAS, despite serious efforts of the Province to segregate biodegradable, recyclable
and reusable waste materials, plastics, polystyrene and other similar materials remain in the

tourism sites, parks and beaches waste stream of the Province of Ilocos Sur and eventually
remain as the common residual waste fraction;
WHEREAS, the 10th Sangguniang Panlalawigan of Ilocos Sur aims to craft and pass an
expedient legislative measure to minimize the litter, to keep our natural environment
beautiful and safe;
NOW THEREFORE, BE IT ORDAINED, as it is hereby ordained by the Sangguniang
Panlalawigan of Ilocos Sur, duly assembled that:

SECTION 1. TITLE- This Ordinance shall be known and referred to as the “ORDINANCE
BANNING ALL SINGLE-USE-FOOD SERVICE CONTAINER AND SINGLE-USE-
PLASTIC (SUPs) BAG IN ALL TOURISM SITES, PARKS AND BEACHES WITHIN
THE PROVINCE OF ILOCOS SUR’’

SECTION 2. DECLARATION OF POLICY- The Provincial Government of Ilocos Sur


provides legislative measures to protect the environment, the economy, and health of the
citizens.

SECTION 3. DEFINITION OF TERMS- For purposes of this Ordinance, the following


terms shall be defined:

a. Alternative packaging materials- refers to recyclable, reusable and/or biodegradable


packaging materials that are used in containing, carrying, holding and /or transporting
goods or products, as an alternative to plastic bag;
b. Bring Your Own Bag/Container (BYOB/C) Program- refers to a program whereby
citizens are enjoined to bring a reusable containers or any other alternative packaging
material for purposes of containing, carrying, holding foods and drinks to bought.
c. Cloth bag- refers to reusable packaging material made of cloth used in the packaging
of flour, wheat and other similar goods.
d. Container/s- refers to a type of material utilized for purposes of holding, enclosing,
packaging and/or restraining edible food and beverage for human consumption.
e. Expanded polystyrene (EPS) foam- is thermoplastic petrochemical material which
utilizes a styrene monomer and is processed by fusion of polymer spheres. It is a type
of polystyrene product commonly used as containers for food and beverages.
f. Packaging – shall refer to the packaging, packing and wrapping of products for
purpose of carrying the same in a convenient manner.
g. Plastic bag – refers to a type of bag made of thin, flexible, plastics film that is
designed to be provided or utilized at the point of sale for containing, carrying,
holding and transporting goods.
h. Plastic wastes- refer to any plastic packaging material thrown as wastes.
i. Plastic cellophane- is transparent, thin film plastic sheet made of regenerated
cellulose having low permeability to air, oil, greases, bacteria and water makes it
useful for food packaging.
j. Reusable bag- refers to a washable canvass bag or native bag “bayong” or any
shopping bag used for carrying and transporting goods, which bags are made of
organic or non-organic materials that can be used for several times.

k. Sando bags – refers to a type of plastic packaging with handles for the purpose
ofcarrying, holding and/or transporting goods and other produce. This term shall
likewise be defined as one similar to the term plastic bag.
l. Single-use- disposable or used for only one time.
m. Styrofoam – is a trademark of a product made up of light resilient foam of
polystyrene. For purposes of this Ordinance the term “Styrofoam” shall refer to the
Expanded Polystyrene (EPS) Foam used as containers for food and beverages.
n. Woven bags- refers to biodegradable packaging material made of woven native
materials e.g. pandan or buri leaves and other similar materials.
o. Single-Used Plastic (SUPs) – shall refer as plastic drinking cups; plastic condiment,
sauce or gravy container, both recyclable and non-recyclable; plastic cup lids or
covers; plastic stirrers; plastic cutlery (spoon, knife, or fork); plastic straws; plastic
meal packaging; plastic hand gloves; plastic materials used as “buntings”; and plastic
materials used as balloon sticks.
p. Polystyrene- A colorless, hard plastic without much flexibility. It can be made into
foam or cast into molds and given fine detail in its shape when it is manufactured, for
instance into the shape of plastic spoons or forks. Commonly used to make plastic
cups, deli and bakery trays, fast food containers and lids, hot cups, and egg cartons.
q. Water flask or reusable water container- is a container that is used to hold water,
liquids or other beverages for consumption. The use of a water bottle allows an
individual to drink and transport a beverage from one place to another. A water bottle
is usually made of plastic, glass, or metal. Water bottles are available in different
shapes, colors, and sizes. In the past, water bottles were sometimes made of wood,
bark, or animal skins such as leather, hide and sheepskin. Water bottles can be
either disposable or reusable. Reusable water bottles can also be used for liquids such
as juice, iced tea, alcoholic beverages, or soft drinks. Reusable water bottles reduce
plastic waste and contribute to saving the environment. Easily portable, water bottles
make for convenient use. Water bottles often list nutrition facts.
r. Food containers – is any container that is use to hold any food that could be recycled
and be reuse to avoid the use of single plastic containers that is pernicious to the
environment.

SECTION 4. COVERAGE-This Ordinance shall be implemented and enforced within the


territorial jurisdiction of the Province of Ilocos Sur. And to ensure that every individual
entering the above premises, locations and recreational facilities are not in possession of any
prohibited items mention in this ordinance.

SECTION 5. PROHIBITED ACTS – It is hereby prohibited for any person, whether natural
or juridical, to:

a. Bring and Use Single-Use-Food Service Container and Single-Use-Plastic (Sups) Bag
in All Tourism Sites, Parks and Beaches within the Province of Ilocos Sur;

b. Business establishments, fast-food outlets, market vendors, food kiosks, sari-sari


stores, ambulant vendors, and the like in all tourism sites, parks and beaches are
prohibited from using plastic cellophanes and sando bags as packaging materials for
customers.

c. Stores and other retail establishments in all tourism sites, parks and beaches are
mandated to use any alternative legally compliant packaging material for customers,
such as but not limited to the materials mentioned in Section 3 hereof, in lieu of
single-use plastic cellophanes and sando bags.

SECTION 6. ALTERNATIVE PACKAGING MATERIALS-The use of recyclable, reusable


and/or biodegradable alternative packaging materials should be encouraged and promoted,
such as reusable woven bags (bayong), cloth bags, rattan baskets, shopping bags made from
recycled waste paper and other bags made out of biodegradable materials (e.g. banana leaves,
taro leaves, water lily, corn stalk, etc.) shall be utilized as alternative packaging materials. All
citizens and business establishments are encouraged to adopt the “Bring Your Own
Bag/Container” Program.
SECTION 7. ALTERNATIVE CONTAINERS FOR FOOD AND BEVERAGE. The use of
reusable and/or paper-based containers for food and/or beverage and other alternative
containers are encouraged and promoted.
SECTION 8. TECHNICAL WORKING GROUP. For the purpose of this ordinance, a
Technical Working Group shall be established with the following composition:
Chairman Governor
Co-Chairman Vice Governor
Vice Chairman SP Committee Chairman on Environment
Members The Provincial Environment Natural Resources Office (PENRO)
Provincial Tourism
Public Information Office
SP Committee Chairman on Trade & Industry
SECTION 9. FUNCTIONS OF THE TECHNICAL WORKING GROUP. THE
TECHNICAL WORKING
Group shall have the following functions:
a. The formulation of the Implementing Rules & Regulations as well as the Guidelines
in the proper implementation of this Ordinance.
b. Identify the activities and programs to be conducted during the moratorium period.
c. Identify the environmental advocacies, programs and projects to be funded by the city
government.
Recommend measures for the proper implementation of this Ordinance.
SECTION 10. MONITORING OF ORDINANCE- the Provincial Environment Natural
Resources Office (PENRO) in coordination with Law Enforcement Team (LET) shall
monitor the effective implementation of this Ordinance and shall likewise prepare a periodic

report on the progress of the implementation of this Ordinance and shall furnish the
Sangguniang Panlalawigan a copy of the same.
SECTION 11. INFORMATION, EDUCATION AND COMMUNICATION CAMPAIGN-
Upon approval of this Ordinance, the Province through the Public Information Office
together with the Provincial Environment Natural Resources Office, Provincial Tourism
Office in coordination with the Technical Working Group, shall conduct massive
information, education and communication campaigns using quad media (print, radio,
television and internet) and shall include the promotion of alternative biodegradable
packaging materials. The information and education campaign shall include the production
and distribution of materials related and consistent with the provisions of this Ordinance.
SECTION 12 . PENAL PROVISION- Any person caught in violation of the ordinance shall
upon conviction thereof, be punished by fines of:
Php 1,000 for the first offense
Php 3,000 for the second offense, and
Php 5,000 for the third offense.

For Business Establishment caught in violation of the Ordinance shall upon


conviction thereof, be punished by fines of:
Php 1,000.00 for the first offense,
Php 3,000.00 for the second offense, and
Php 5,000.00 and revocation of license to operate for the third offense.

SECTION 13. REPEALING CLAUSE- All laws, orders, regulations, or parts thereof,
inconsistent with the provisions of this Ordinance, are hereby repealed or modified
accordingly.

SECTION 14. SEPARABILITY CLAUSE-In event or for any reason/s, any part/s, sections/s
or provision/s of this Ordinance shall be held or declared be unconstitutional or invalid, the
remaining part/s thereof which are not affected thereby, shall continue to be effective and in
full force.

SECTION 15. EFFECTIVITY- This ordinance shall take effect 15 days upon approval,
posting and publication pursuant to the provisions of the Local Government Code of 1991.
