EARNEST MONEY RECEIPT AGREEMENT

  
Received from JANICE MAJAM OLEDAN, of legal age, Filipino, single and resident
of 19A Matutum St., Sta. Mesa Heights, Quezon City, the sum of  One Hundred Thousand
Pesos (Php 100,000.00) in cash representing EARNEST MONEY for payment of a parcel of
land designated as Lot No. 5959-E-5-A-8 situated at Brgy. Nula-Tula, Tacloban City, more
particularly described as follows:

Transfer Certificate of Title No. T-67996


Tax Declaration No. 2012-02-0025-01124

“parcel of land designated as Lot 5959-E-5-A-8 of the subdivision


plan Psd-08-008196-D, being a portion of Lot 5959-E-5-A, Psd-08-
004028 situated in the Barangay of Nula-Tula, City of Tacloban,
Province of Leyte containing an area of Two Hundred (200) square
meters, more or less. Bounded as follows:

SE Along line 1-2 By Road Lot 28 (15.00m wide) Pcs-08-000376-D


SW Along line 2-3 By Lot 5959-E-5-A-7 of this subdivision
NW Along line 3-4 By lot 5959-D-3-D, Psd-08-003011-D
NE Along line 4-1 By lot 5959-E-5-A-9 of this subdivision

This EARNEST MONEY forms part of the purchase price of ONE MILLION PESOS


(Php1,000,000.00). The balance and full payment shall be paid on or before March 2, 2020.
 
The BUYER hereby reserves the exclusive right to purchase the aforementioned
property and the SELLER cannot offer the aforementioned property to any third party until
the above-mentioned date (March 2, 2020).
 
Upon full payment, the SELLER shall execute a DEED OF ABSOLUTE SALE in favor
of the BUYER, conveying the subject property with full warranty of a legal and valid title as
provided by law, free and clear from any liens and encumbrances.
 
Upon execution of the DEED OF ABSOLUTE SALE, the BUYER shall undertake the
payment of the Capital Gains Tax, Documentary Stamps Tax, Transfer
Tax, Registration Fee, notarization fee of the deed of sale, and all other expenses necessary
to transfer the title of the property under his name.
 
In case of voluntary cancellation of this agreement by the BUYER without any cause
on the part of the SELLER or if the BUYER fails to pay the full purchase price on or before
March 2, 2020, then the SELLER shall have the right to terminate this agreement, and the
above-described parcel of land may be offered to another prospective buyers. BUYER
further agrees to forfeit Thirty Thousand Pesos (Php30,000) from the earnest money as
liquidated damages.

  IN WITNESS WHEREOF, we have hereunto set my hand this 21 st day of February


2020 at Palo, Leyte, Philippines.
