Topic 10 (MODULE 4/WEEK 4)

Agencies attached in the Department of Interior and Local Government (DILG)

Objectives:
At the end of the lesson, the students should be able to:
 trace the historical development of the public safety agencies in DILG;
 distinguish the functions of different public safety agencies in the DILG;
 recognize the organizational structure, recruitment process, promotion, retirement, benefits, and
disciplinary mechanism of the law enforcement agencies attached in the DILG.

Agencies in DILG
I. Bureau of Fire Protection (BFP)
 created by virtue of RA 6975.
 the government fire service of the Philippines
II. Bureau of Jail Management and Penology (BJMP)
  created by virtue of RA 6975.
 mandated to direct, supervise and control the administration and operation of all
district, city, and municipal jails nationwide with pronged tasks of safekeeping and
development of inmates.
III. National Police Commission (NAPOLCOM) - the agency mandated by the 1987 Constitution
and the Major Police Reform Laws, Republic Act Nos. 6975 and 8551 to administer and control
the Philippine National Police.
A. PHILIPPINE PUBLIC SAFETY COLLEGE
Mandated to provide training and education needs to uniformed members of the PNP, BJMP, AND BFP.
B. PHILIPPINE NATIONAL POLICE

I. ORGANIZATIONAL STRUCTURE
The compositions of the PNP in its Organizational Structure are:
a. National Office
b. Administrative Support Units or Services
c. Regional Office
d. Provincial Office
e. District Office in case of large provinces and cities
f. Municipal stations

NCRPO is composed of five (5) District Directors and each assisted by a Deputy Director.
The NCR PNP is headed by a Regional Director with the rank of two (2) stars Deputy Director and
assisted by two (2) Deputies:
1. Deputy for Administration (1 Star)
2. Deputy for Operation (1 star)

Supervision and control of the City Police Force of highly urbanized cities is provided by the Regional
Commander of the area.

The three (3) classifications of city or municipal police forces outside the director control of Regional
Director are:
Cities Class A – in the cities with 100, 000 population and up
Class B – in the cities with 75, 000 to 99, 999 people
Class C – in the cities with less than 75, 000 people
Town Class A – in town with 75, 000 people and up

POLICE RECRUITMENT AND SELECTION PROCESS

RECRUITMENT
 The process of attracting applicants who have the minimum qualifications to be eligible for the selection
procedure.

SELECTION
 It is the process of screening out undesirable candidates after they have applied and likewise involves the
appointing of qualified applicants.
A. Initial Application

B. Qualifying Examination
The scope of the examination are as follows:
1. Philippine Constitution
2. IQ Test
3. Abstract Reasoning
4. Current Events
5. PNP Organization/LEA
C. Physical Agility Test
 It determines physical strength and stamina of an applicant that will be needed in police work.

D. Physical and Medical Examination


 It involves the conduct of thorough physical and medical examination to include dental
examination.
E. Neuro Psychiatric Examination
 It includes psychological and sociological tests.
F. Character and Background Investigation
 It serves to verify information stated in the application form of a prospective employee.
G. Final Interview
 It is the last or ultimate phase in the selection process.

APPOINTMENT
 It is the designation of a person to an office position by a competent authority.
Types of Appointment
1. Temporary - It is granted to an applicant who does not possess all the basic requirements.
2. Probationary - It is granted to all newly appointed Patrolman/Patrolwoman subject to the completion of
the Field Training Program before the appointment is made either permanent or temporary.
3. Permanent - It is granted to applicants who meet all the basic requirements for appointment.

Appointment in the PNP shall be affected in the following manner:

Note: The CPNP shall serve a tour of duty not exceeding four (4) years. However, in times of war or other
national emergency declared by Congress, the President may extend his tour of duty.

TRAINING
Types of Training Programs
A. Basic Recruit Training - Most basic of all police training which is a prerequisite to permanency of
appointment.
Public Safety Basic Recruit Course
 It provides all police officers with the fundamental perspective, attitudes, skill which is necessary in
police work.
Order of Merit
 Final listing of all the PO rank after training from highest to lowest
 The top 3 are awarded the PNP Medalya ng Kasanayan (Efficiency Medal)
 Lowest serves as the Class Goat.

B. Field Training Program - It is the process by which an individual police officer who is recruited into
the service receives formal instruction on the job for special and defined purposes and performs such
actual job functions with periodic appraisal on his performance and progress.

ASSIGNMENT
 The process of designating a police officer to a particular function, duty or responsibility.

Swapping - It involves the change of assignment between two officers from one unit to another.

PROMOTION - It is the grant of higher rank to a police officer.


Kinds of Promotion
1. Posthumous - This is given to PNP personnel who die while in the line of duty.
2. Special/Meritorious - Given to a PNP officer who has performed an act of extra-ordinary gallantry and
heroism with risk of life and beyond the call of duty.
3. Regular/Ordinary - Given to a PNP officer who possesses all the requirements/qualifications for
promotion.

Qualifications
A. Educational Attainment - He or she must possess the minimum educational attainment but higher
educational attainment is the more chances he or she is promoted.
B. Appropriate Eligibility - He or she must pass the PNP promotional exam.

D. Time-in-Grade - Period of time that had elapsed since an officer is appointed to his rank in permanent
status.

Note: All candidates for promotion must pass the adequate requisite of medical and neuro-psychiatric exam.

Lateral Entry - Only for licensed criminologists wherein you will be assigned in the line service.
RETIREMENT
 A process wherein a PNP officer leaves or exits in the police service.
Kinds of Retirement
1. Mandatory
2. Optional
3. Early
Note: In Mandatory and Optional Retirement, the retired PNP member shall receive his retirement benefits.
(Monthly Pension for Life)

Longevity Pay - Additional incentive for police officers for 5 years or more of satisfactory service rendered.
1. 5 to 9 years = 10% of base pay
2. 10 to 14 years = 20%
3. 15 to 19 years = 30%
4. 20 to 24 years = 40%
5. 25 and above = 50%
Note:
 The retired PNP personnel have the option to receive in advance and in lump sum the first 5 years of his
or her retirement benefit.
 Then, he receives his or her monthly pension after 5 years.
 If a retired PNP dies within the 5 years period after appointment, the next of kin receive
SURVIVORSHIP PENSION.

LATERAL ENTRY PROGRAM - A process wherein a highly skilled and competent individual is appointed in
the PNP is appointed in the PNP with an initial rank of either Inspector or Senior Inspector.
ATTRITION - It is the process of removing from the police force inefficient, unproductive, and ineffective
police officers.

Kinds of Attrition
1. Attrition by reaching the Maximum Tenure
2. Attrition by Relief
3. Attrition by demotion in rank or in position
4. Attrition by non-promotion
5. Attrition by other means

Note: In the attrition system, a police officer attrited could be:


a. SEPARATED – if he or she have rendered less than 20 years of service.
b. RETIRED – if he or she have rendered 20 years or more of service.

WAIVER PROGRAM - One particular process wherein applicants who do not possess all the 10 minimum
requirements are still accepted or appointed in the PNP. It only applies when the no. of qualified applicants fall
below the quota.
The minimum requirements can be availed in its order of preference:
A. Age - Applicant must not be less than 20 years nor more than 35 years old at the time of the
appointment.
B. Height
 Must not be less than 1.57 m/5’2” (M) and 1.52 m/5” (F).
 Members of the indigenous communities are certified by the NCIP are given a lower height
requirement provided he or she applies in the Police Regional Office where the indigenous
community is located.
C. Weight
 Must not be less than nor more than 5 kgs of standard weight in accordance with the
person’s age, height and gender.
 All appointees are given 6 months to come up with the required weight.

D. Education
 Applicant must have earned 72 college units.
 All applicants are given 5 years after appointment to finish a BS Degree.

INSPECTION
It is done regularly to ensure actual strength of a PNP unit that all personnel are adept to the latest order
or memoranda from higher authority. And police unit is capable of responding to any eventuality in their
AOR.

DISCIPLINARY MECHANISM
Administrative Offenses against Policemen
1. Neglect of duty or non-feasance
2. Irregularity in the performance of duty or misfeasance
3. Malfeasance
4. Incompetence
5. Oppression
6. Dishonesty
7. Disloyalty to the Government

Administrative cases against policemen may be filed either in PLEB, IAS, NAPOLCOM, or in any other
quasi-judicial bodies but the filing to one of them prohibits further filing to another quasi-judicial bodies;
otherwise, certification against forum shopping is violated. (Timpac, 2009)
Forum Shopping - known as multiple filing of a complaint where a complainant files the case in more than one
disciplinary mechanism. The complainant must certify that he did not commit forum shopping through a
Certification Against Forum Shopping.

Certification Against Forum Shopping - It states that a complaint or a charge filed against a PNP member shall
be heard and decided exclusively by the disciplinary authority who has acquired original jurisdiction over the
case and not withstanding the existence of concurrent jurisdiction as regards the offense.

Effect of Violating the Prohibition on Forum Shopping


The violation of prohibition against forum shopping shall be a ground for the dismissal of the case at the
instance of the hearing authority or upon motion of the respondent. (Section 4, Rule 2, NAPOLCOM
Memorandum Circular No. 007-001)

INTERNAL AFFAIRS SERVICE


Composition
1. National Office - It shall be headed by an Inspector General who shall be assisted by a Deputy Inspector
General.
2. Regional Offices – it shall be headed by a Director.
3. Provincial Offices - it shall be headed by a Superintendent.

Requirements and Prohibitions of IAS Membership


1. The entry to IAS shall be voluntary and subject to rigid screening.
2. The PNP personnel who became members of IAS must have at least five (5) years experience in law
enforcement.
3. The person who joins the IAS may not thereafter join any other unit of the PNP.
4. A member of IAS shall not be allowed to sit in a committee deliberating on the appointment, promotion,
or assignment of any PNP personnel.

Preventive Suspension - It is the act of suspending a police officer while a case against him is being heard.

Summary Dismissal
The NAPOLCOM, the PNP Chief, and PNP Regional Directors, after due notice and summary hearings,
may immediately remove or dismiss any respondent PNP member in any of the following cases:
a. When the charge is serious and evidence of guilt is strong.
b. When the respondent is a recidivist or has been repeatedly charged and there are reasonable grounds
to believe that he is guilty of the charges.
c. When the respondent is guilty of a serious offense involving conduct unbecoming of a police
officer.
d. When any member or officer of the PNP who shall go on Absence without Official Leave (AWOL0
for a continuous period of thirty (30) days or more.

Breach of Internal Discipline


Minor offenses shall refer to acts or omissions not involving moral turpitude, but affecting the internal
discipline of the PNP.

Citizen’s Complaint - A formal charge initiated by a natural or juridical person or his/its duly authorized
representative or guardian on account of an injury, damage, or, disturbance sustained as a result of an irregular or
illegal act or omission of a PNP member.

THE PEOPLE’S LAW ENFORCEMENT BOARD (PLEB) - It shall be the central receiving entity for any
citizen’s complaint against the officers and members of the PNP.

WOMEN’S DESK - To comply with the program of establishing Women’s Desks in all police stations
throughout the country, the PNP shall prioritize the recruitment and training of women who shall serve in the
Women’s Desk. Pursuant to this requirement, the PNP shall reserve ten (10%) percent of its annual recruitment,
training, and education quota for women.
