Scams and Unfair Sales Practices

1. Consumer fraud, scams and unfair sales practices (if you or someone you know have
experienced this, also include this in your paper)
Answer:
Nowadays, consumer frauds, scamming, and unfair practices are being
experienced by most consumers not only in buying goods and services. But we also
scammed during our trips or vacations just like we can encounter broken taxi meter,
overbooked of hotels and so on. It sucks to get scammed by a stranger when you’re
traveling on vacation just like what happened to us with my friends. To make the long
story short a friendly local approached and informed us that the attraction we want to
visit is closed for any reasons. After that then they’ll guide you to a different attraction or
shop where you’re pressured to purchase something or pay a lot for entry. But before we
scammed, we noticed what the local guy is doing so we just thanked him but ignored the
advice and found the original place open.

2. How are consumers protected against these acts?


Answer:
Since we all need to purchase items, every person can be classified as a consumer
in certain contexts. The Consumer Act of the Philippines is therefore vital for ensuring
that all our rights as consumers are protected, and that we aren’t exploited by unethical
service providers or marketers. Through this act, consumers can exercised their rights to
choose what products they were to buy and this includes the right to renew or cancel
fixed term agreements; to request quotations for maintenance and repairs; to return
defective goods and seek redress for unsatisfactory services; to cancel direct marketing
contracts; to cancel reservations, bookings or orders; and to choose or examine goods,
even after purchase and delivery. Consumer can also exercise their rights to have quality
and safety of products purchased. This includes the right to warranties; to receive
warnings on the facts and nature of possible risks of a product; to have products
monitored for safety and/or recalled; and to claim damages for injuries caused by unsafe
or defective products. By knowing your rights as a consumer, you are empowered to act
whenever you feel like any supplier is treating you unfairly.

3. The role of the Department of Trade and Industry plays in those situations
Answer:
The Department of Trade and Industry (DTI) is a prime mover of consumer
welfare. It is committed to protecting the rights and interests of the consumers and is also
committed to developing policies and programs aimed at sustaining the growth and
development of the Philippine economy. Besides overseeing the effective implementation
and enforcement of trade regulation and fair trade laws, the DTI provides protection to
consumers through consumer education and information dissemination programs.
So in other words DTI helps the consumers to secure their safety in buying
different products and services. They also the one who secure that the seller or an entity
who sell certain products or services practiced the required rules and regulations by the
government.

4. Knowing what you now know about consumer fraud, scams and unfair sales practices,
what will you do as aware buyers? Expound
Answer:
To be honest I’ve avoided telling my scam experienced to anyone; the experience
wasn’t something I’m proud of. I was ashamed of what happened. And that, in itself, is a
problem. Most scam victims avoid talking about it because they don’t want to come off as
gullible or, worse, stupid. Scammers are very meticulous; they know how to target the
right people to manipulate and exploit. So I realized that we must share our experiences to
other people so that they also aware about certain frauds or scam. Just like what I told in
my no. 1 answer, we almost scammed by locals, so for us to avoid it instead of taking the
local’s word, head to the ticket counter or shop and see for yourself. Or ask someone else
nearby for confirmation.
The truth is that no matter how prepared you think you are, you’ll eventually fall
for some sort of scam or fraud. So you need to be an observant always what happening in
your surroundings. It’s embarrassing to be tricked out of your money, but there are
always worse things that could happen. It’s just a learning experience.
