    MOTION FOR EXTENSION OF TIME TO FILE COMMENT

    Comes now Respondent and unto this Honorable Court, respectfully


    states that:

    1. He is the Respondent in AC No. 6429 entitled HAZEL M. CALUCAG, ET.

    AL. –versus- ATTY. HAXLEY M. GALANO, which is pending before this

    Honorable Division of the Honorable Supreme Court;

    2. Respondent has an office address at Maharlika Highway, Carig Sur,

    Tuguegarao City, Cagayan (c/o SALUD BALANON AND GALANO LAW

    OFFICES) and hence, all notices and processes of the Honorable Court

    should be sent to said address and not in Cagayan State University

    because he is no longer connected with the University since June 2004;

    3. On August 27, 2004, Respondent received a Resolution of this Honorable

    Court on a complaint filed by herein complainants, through their counsel,

    charging him of illegal practice of law and conduct unbecoming a lawyer

    and requiring him to COMMENT on the matter within ten (10) days from

    receipt of the same or until September 6, 2004, which period is due to

    expire at the close of office hours today;

    4. Considering the gravity of the charges in the complaint that may result to

    the suspension or disbarment of the Respondent from the legal

    profession, and with his present commitment, herein Respondent cannot

    be expected to submit the required COMMENT within the remaining

    hours;

    5. Respondent filed the foregoing motion with all urgency and with no

    intention whatsoever to delay or obstruct the speedy administration of

    justice; and

    6. For this reason, Respondent moves for a ten (10) day extension of time to

    file his COMMENT, or until September 16, 2004 in order to adequately and

    intelligently prepare the same as this COMMENT may very well be the last

    pleading that he may file if his membership in the legal profession be cut

    short because of this complaint;

    PRAYER

    WHEREFORE, premises considered, it is most respectfully prayed that

    Respondent be granted a ten (10) day extension, or until September 16, 2004, to

    submit his COMMENT on the complaint.

    Other reliefs, just and equitable under the premises, are likewise prayed

    for.
