English Abstract: This paper brings to the forefront a number of law and ethics issues on the object of the attack in the case of self-defence.A first issue concerns the elucidation of that mental mechanism, an "animus defendendi" which causes the individual to intervene in defense of a third person or their rights. Of particular interest is the acknowledging of the existence of legitimate defence in favor of an unborn child. It is also envisioned the issue of suicide, euthanasia, assisted death or the discontinuation of a treatment.All these issues, due to their heavy emotional load, have triggered off profound legal and moral-Christian controversies, resulting in the most diverse legislative solutions both globally and in Europe.In terms of forming a relevant and well-founded point of view, we considered different European legislations, placing, however, the emphasis on the position of the European Court of Human Rights.Romanian Abstract: Prezenta lucrare aduce in prim p...

The right to defense as a social value is necessary for any social environment, and the arising of its elements during various stages of civilization has witnessed a visible progress, considering that nowadays the acknowledgement of the right to defense is a common denominator in all procedural systems of democratic states; and this also derives from the fact that states are covenanters to international documents expressly consecrating this right. This article aims to examine the provisions of main international instruments guaranteeing the right to defense and to present relevant aspects of the ECHR jurisprudence meant to express the requirement of compliance with the essential guarantees implied by that right.
This text can be divided into two parts: the first deals with modeling of dynamic systems, passing through the so-called strong formulation to the concept of variational formulation, considering the basic tools of variational calculus and the Hamilton Principle. The concepts are exemplified by two structures that follows the whole text: a unidimensional cable and a plate. Still in the first part, the eigenvalue problem of continuous systems is presen- ted and the properties of self-adjoint operators are shown. Throughout this stage and at the appendix, analytical solutions to the eigenvalue problem are developed. As to get the problems analytical solutions may be too inge- nious or even impossible, another way is proposed: the use of approximate solutions, which is the theme of the second part of this text. It starts by presenting methods of discretization of continuous systems, exemplifying them. The methods are used as tools for approximation of the vibration modes. The Ritz, Galerkin and Collocation methods are exposed. The func- tions used at the first and at the second are generated by the Finite Element Method and the modes approximated by this method are used to reduce the systems to then obtain the dynamic response to a given dynamic loading. The whole theory is reinforced with two practical problems at the end: one is about a cable during a supplying operation of an oil rig and the other is about a plate during a shot blastening operation. Last but not least, a chap- ter is devoted to the Collocation Method, where higher-order polynomials, the Chebyshev polynomials, are used to the approximation using different interpolation grids, the Chebyshev-Gauss and the Gauss-Lobatto grid. Cette contribution est structurée comme suit. La Section 1 énonce les principes de la répartition des compétences en matière fiscale, déjà bien documentés ailleurs, au travers de l’articulation entre les principes d’autonomie régionale et de primauté fédérale. La Section 2 aborde ensuite la répartition des compétences en matière budgétaire en parcourant les principes d’autonomie, d’encadrement fédéral et de coopération interfédérale qui la régissent. Enfin, la Section 3 expose le principe du parallélisme entre l’exercice de compétences matérielle et budgétaires, tout en soulignant l’ampleur des dérogations à ce principe rencontrées dans l’ordre juridique belge.
