Compliance costs and cost of compliance refer to the expenses incurred by an organization or individual in the course of obeying legal and regulatory requirements. For example, when an individual files a personal income tax return, they incur compliance costs such as the time it takes to prepare a tax form or the fees they might pay to a professional tax preparer or advisor. Penalties for noncompliance, such as fines assessed to a firm found in violation of a regulation, are not considered compliance costs.[1][2]
Background
Rules issued by administrative agencies and laws enacted by Congress or a state legislature often restrict or require certain actions as a condition of participation in a particular activity or industry. The compliance costs of a law or regulation include the time, money, and other resources that must be spent by an individual or organization in order to meet these legal or regulatory requirements. Compliance costs do not include the penalties than an individual, business, or nonprofit organization may face for violating a law or regulation.[1][2][3]
Sources of compliance costs
According to the U.S. Department of Commerce and several glossaries of legal and regulatory terms, the sources of compliance costs for businesses, nonprofit organizations, and individuals include but are not limited to:[4][1][2][3]
- Criminal legislation addressing bribery, terrorism, and money laundering
- Environmental regulations, including requirements for Environmental Assessments and Environmental Impact Statements
- Human resources regulations
- Payment of compliance officers and legal advisors
- Permitting and licensing requirements
- Public health and safety regulations
- Purchase of new equipment or systems
- Reporting requirements
- Taxes, including the costs of preparing tax forms and hiring tax professionals
