DraftKings sells VSiN back to Musburger Media

Steven Jacobs, the lawyer representing the DraftKings customer data leak case, has acknowledged that he is also the case’s anonymous plaintiff.
This report is the most recent development in the legal dispute between DraftKings and Jacobs. DraftKings is accused of disclosing customer information, which is what allegedly triggered a man in a mask attacking Jacobs.
In a letter to the court dated 28 June, Jacobs said:
“I am the plaintiff in the above-captioned action.Pursuant to the court’s order dated June 17, 2024, I write to inform the court that I no longer wish to proceed under pseudonym.”
DraftKings, whose move is scheduled to be filed on August 8, strongly denies the accusation and is advocating for the lawsuit to be dismissed.
DraftKings requested a brief stay of discovery in a letter to the court prior to the petition.
The company emphasized Spanky’s social media comments, in which he denied getting information from DraftKings or being involved in the claimed masked man incident. Screenshots of the statement were presented as an exhibit.
DraftKings’ attorneys said:
“These admissions from Mr. Kyrollos, if true, highlight that Plaintiff’s Complaint is baseless and discovery is particularly inappropriate until the Court rules on DraftKings’ motion to dismiss.”
The letter from DraftKings went on to say that Jacobs’ “overbroad and unduly burdensome” discovery request supported the stay move.
In addition to DraftKings’ internal policies and procedures, Jacobs is requesting all correspondence and records pertaining to his account.
The company added:
“Searching, inspecting and reviewing documents would require a substantial and unreasonable amount of time and expense, potentially requiring the disclosure of confidential and proprietary information.”
Additionally, DraftKings contended that their move to dismiss would be strong enough to provide as an additional justification for a stay.
