    This is the Truth concerns the very foundation of our Republic’s promise to all Americans. Every official holding office is required to abide by this foundation through their oath of office. Violation of this oath of office has severe consequences of which the average person is oblivious. Our government is based on authority and jurisdiction. The essentials are simplified here for the common person to understand so that they can hold public officials to this code of office, therefore securing their own rights under the law.

    Arminda began her journey learning about the foundation of our Republic because she was being treated poorly in court even though she had a good attorney. The attorney she hired seemed hesitant in defending her position before the judge.
    After one particularly frustrating event, she was standing in her kitchen feeling frustrated and overwhelmed at the monumental task of getting relief from the court and asked for help. Rick came into her life and tutored her on the very foundation of the court system. He brought all the knowledge down to two points: Authority and Jurisdiction. He said, "Do not budge off. They never do it right." She does not always prevail against the system; however, she now knows what the truth is.
    Rick has since left this world. The information he passed onto her is now being passed onto you through this book. Her desire is to show you that you are enough; you are capable of clearing the great fog created by the judicial process and keep the abuse at arms length.

      Chapter 1

      Foundation

      There is no silver bullet.

      Do you buy into that statement?

      Well, I lied.

      You are the silver bullet. And you are being manipulated.

      This is not a set-up of us v. them mentality. Officials are at fault for perpetuating a fraud as we – non-officials – are at fault for allowing the perpetuation of the fraud. We gave up learning. This is a 2-way street.

      That is the truth!

      We are in this together, and it will take time, understanding, and enforcing the truth to bring us out of our ignorance. Toes will be stepped on to straighten this mess out to be what our Republic is. This book is designed to simplify the foundation which every official that represents our government needs to know. That foundation is based on authority and jurisdiction, and without authority there is no jurisdiction. This is shared to the best of my knowledge at this point. There may be typo errors in this book. I humbly apologize.

      I am unsure how to present this information to anyone in a thorough manner. The information presented is the result of twenty plus years of learning and working at getting a remedy. This is simply a foundation to start. I am in no way giving legal or lawful advice.

      Website thisisthetruth2.wordpress.com is being created where court cases using this information substantiates, to show you that what is presented here is accurate. One incident with one judge took seven appearances in court before the judge and assistant prosecuting attorney, discharged the case unlawfully, never notifying me that the case was dismissed. Denying proper courts to me. This is a violation of due process along with denial of my right to face my accuser. This fraud kept the door open for officers to continue to harass me as the court evaded a ruling in law protecting my inalienable rights. I submitted a FOIA, Freedom of Information Act, for the judge’s oath.

      Determining the truth is crucial to just parroting information. The simplest way to understand what attorneys, judges, officers really mean in their words in a court situation is to read the definitions of their words in a law dictionary. Bouvier’s, Ballantine’s, and Black’s law dictionaries are used by the legal system to define the words used in government. I purchased a Black’s Law 4th Edition because it has explanations, case law, and details that the fifth edition onward simply has eliminated. The fine print is very enlightening. The current dictionaries are thinner and crucial information, such as case law in footnotes, has been removed.

      As you read This Is The Truth, write in this book, make notes on the pages, use a highlighter, put plastic tabs on the pages noting what is important so you are able to find the information quickly. There have been many times I found information, swore I would remember where I found it, and then – voila – was not able to find it.

      I have used bold and underlined sections or words because the point needs to stand out and get your attention.

      First foundational statement

      Every act and action committed by an official is based upon authority and jurisdiction. The most important of these two is authority. Until those two points are satisfied as lawful, in compliance with the constitutions, everything else is put on hold. I do not move forward or let the judge move forward with the case until the issue is resolved.

      I want to know who I am dealing with in court, make sure they are who they say they are, know what their duties and responsibilities are, make sure the officials have the proper paperwork filed to hold office, and have the officials uphold the constitutions. Obtaining the oath and bond of all officials is crucial.

      Get a copy of both constitutions and read them. The federal constitution is superior to the state's constitution; all state constitutions must be in conformity with the federal constitution.

      Second foundational statement.

      The first statement from my tutor was, Don’t you do anything with what I tell you until you prove it to yourself, or you will get into trouble.

      That is your first lesson. Learn in chunks. Our ignorance has been decades in the making. Breathe deeply. Learn solidly. Because when you, if you, end up in court, those officials are trained in intimidation. They have spent a good deal of money on college, a good deal of time learning to lie, manipulate, and defraud. Being pushed around is okay because that is sometimes the way we learn.

      The first thing to do in any instance with the government is to:

      FOIA. GET THE OATHS OF EVERY OFFICIAL INVOLVED:

      COPS, JUDGES, PROSECUTORS..

      Why? you ask. That is a fine question.

      Every officer must present his/her oath of office. Without that sworn oath, there is no authority. That oath covers both the federal constitution and the state constitution. The oath must be in compliance with the demands of the constitutions, it must have a notarial officer or a notary public as witness, and it must have the appropriate seal along with the date of the swearing in. Most important, these people swear they will always protect our rights because our rights are their rights too.

      Judicial Due Process

      Under federal Law, which is applicable to all states, the U.S. Supreme Court stated about courts: But if it act without authority, its judgements and orders are regarded as nullities. They are not voidable, but simply void, and form no bar to a recovery sought, even prior to a reversal in opposition to them. See Elliot v. Piersol, 1 Pet. 328, 340, 26 U.S. 328, 340 (1828).

      A thought for those that desire to know the facts presented to you here are true. Prove what I am telling you is wrong. Challenge the validity of what is being presented here because in proving this wrong, you will refine the information, see the truth, and you will always stay on point.

      ALWAYS verify what you are being told no matter who is stating the point. YOU prove it to yourself. A number of well-meaning people do not verify what they are talking about and pass the misinformation along. I have done just that in the past and found the case law being quoted was misrepresented and attached to the wrong case. Read case law that comes from websites such as Justia Law and Cornell Law School. These sites give access to the fuller rendition of the case so you, the reader, can see the facts and understand the rulings.

      Third foundational statement.

      Every fact stated within this information will be backed up by the constitutions, Am Jur, Corpus Juris Secundum, case law, and Black’s Law 4th Edition dictionary. At no time will I hand information to you without proof and evidence in support.

      Fourth foundational statement.

      No one tells you what to do; however, your choices and decisions up to this point have been due to conditioning; as all of our decisions have. Ideas that have been instilled in your thought process by religion, teachers, politicians, etc. are many times not supported with the truth depending on their level of knowledge and the agenda put forth by said people.

      Fifth foundational statement.

      Legal is not the same as lawful.
