Durante las últimas décadas, los pueblos indígenas que habitan el territorio Chile han gestionado un fuerte posicionamiento, y con este una serie de demandas que durante el siglo XX fueron invisibilizadas, instalando en la agenda de los gobiernos la necesidad de concebirlos no solo como meros ciudadanos de las naciones monoculturalmente construidas, sino como personas portadoras de culturas y derechos otros. Diversas leyes y tratados internacionales que velan por los derechos de los pueblos han complementado este proceso, tales como el Convenio 169 sobre pueblos indígenas y tribales en países independientes de la OIT de 1989 –de carácter vinculante y ratificado por el estado chileno el año 2008– y la Declaración de las Naciones Unidas sobre los derechos de los pueblos indígenas del año 2007, que promueven una nueva institucionalidad y un cuestionamiento a la noción de multiculturalismo neoliberal en pos de instalar un relación más horizontal entre las distintas culturas. Concebir relaciones horizontales resulta un proceso complejo, puesto que muchas veces, más allá de lo que consideramos como buenas o malas intenciones, las ideas y acciones que se desarrollan en el marco del estado provienen solo de un sector involucrado –el que ejecuta-, por lo que la legislación y políticas emprendidas son mayormente concebidas desde contextos en los que no incidieron, directamente y desde su origen, muchas de las partes afectadas, en este caso, los pueblos indígenas.
