The Civilian Board of Contract Appeals (CBCA) is an independent tribunal housed within the General Services Administration. The CBCA presides over various disputes involving Federal executive branch agencies. For more information about the CBCA, see About the Board.

EDS IS ACTIVE

Filers are now required to use EDS (https://www.eds.cbca.gov) for all filings in Contract Disputes Act (CDA) appeals - including appeals under the Equal Access to Justice Act (EAJA) and Indian Self-Determination and Education Assistance Act (ISDA) - and in all Federal Emergency Management Agency (FEMA) arbitrations.

Electronic Docketing System (EDS)

  • Filers will be required to use EDS for all filings in:
    • Contract Disputes Act (CDA) appeals, including appeals under the Equal Access to Justice Act (EAJA) and the Indian Self-Determination and Education Assistance Act (ISDA), and
    • Federal Emergency Management Agency (FEMA) arbitrations.
  • EDS is available NOW to create new user accounts.
  • Parties must create a new user account in EDS prior to filing any documents.
  • Board Rule 4 (48 CFR 6101.4) appeal files or supplements may NOT be filed in EDS.

Rule 4 Appeal File

Parties may submit the Rule 4 appeal file via email at cbca.efile@cbca.gov provided that:

    1) There are no more than 10 total emails, each not to exceed 18 MB.
    2) The index and each exhibit is a separate .pdf file.
    3) Exhibit .pdfs are not merged and do not have embedded files.

The CBCA also accepts Rule 4 appeal files and exhibits by in-person, courier, or mail (USPS/FedEx/UPS) delivery on a CD, DVD, or flash drive or by Secure File Transfer Protocol (SFTP). Timing

For all filings submitted electronically, (efilings and EDS filings), the Board considers filings received by 11:59:59 p.m. Eastern Time as same day filings. Electronic filings received at or after midnight (12:00:00 a.m. Eastern Time) are considered filed the next business day.

Protected Documents

To electronically submit protected documents by efile or EDS, you must first obtain permission from the judge for your case.
